More recent archival legislature defines archival records as those documentary records, "which were received or created by the work of legal or natural persons and has durable importance for science and culture". The most important documents are those which are called the "public archival records", and among these, the selected documents of stale authorities. Until now. the archives have focused their attention primarily on the executive and administrative bodies of government, while the judiciary was more or less neglected. In any period and in any society, however, the work of criminal courts and public prosecutors is very important as criminal courts administer criminal law which has a great impact on the lives of people with the guidelines it sets. The criminal law of a country both shapes and mirrors its society and is a reflection of the level of culture it has achieved.

      • Slovenska najnovejša arhivska zakonodaja določa, daje arhivsko gradivo tisto dokumentarno gradivo, "ki je bilo prejeto ali je nastalo pri delu pravnih oziroma fizičnih oseb in ima trajen pomen za znanost in kulturo". Najpomembnejše gradivo je tisto, ki nosi naziv "javno arhivsko gradivo", in med njim odbrani dokumenti organov - državne oblasti. Arhivi so doslej daleč največ pozornosti in skrbi posvečali drugi veji oblasti, izvršnoupravnim organom. Sodstvo je bilo bolj ali manj zanemarjeno, vendar pa je predvsem delo kazenskih sodišč in tožilstev v vsaki dobi in vsaki družbi zelo pomembno. Kazensko sodstvo je namreč izvajalec kazenskega prava, ki kar najmočneje posega v življenje ljudi in ga usmerja. Kazensko pravo po eni strani družbo oblikuje, po drugi pa jo izraža. V njem odseva njena kulturna raven.
