Opis
The scientific interrelation of the two famous historians of law Sergij Vilfan and Hermann Balti takes center ofthis work. The German version of »Rechtsgeschichte der Slowenen« published in the year 1968 by Hermann Balti as well as Hermann Baltls »Österreichische Rechtsgeschicht first published in 1970 of which today the 10th edition is available build the hinda mental approaches. Balti as well as Vilfan had excellent knowledge and skills in working with docu ments which can be found in archives and libraries. Both of them began to work as a lawyer or at the court. The two men committed themselves to the coverage and recording of the national law of their countries including the economic and social aspects of the history as well as the folkloristic development. Simultaneous they focused on exploring the national history oflaw. Comparing the structure and the systematic approach of the »Rechtsgeschichte der Slowenen« and the »Österreichische Rechtsgeschichte« one can recognize both, sirnilarities as well as differences. Both literary works are based upon a rather similar bibliography regarding the German literature. The authors also chose a similar way ofstructuring the legal history oftheir country, even though one can recognize different characteristic elements. Each work Starts with a historical introduction followed by a detailed chronological analysis. Within this chronological structure both authors subdivided the chapters into political, legal and economical sections in order to better understand the course of history by considering different circumstances. Two significant issues, the lease-law and the Organization of the courts like the allocation of competencies ofthe courts, clearly demonstrate the agreement ofthe two scientists on the one hand and their different perception on the other hand. When Balti as the editor of the »Rechtsgeschichte der Slowenen« mentioned in the preamble of the in 1968 published literature »mit den immer dichter werdenden Beziehungen zu Slowenien, zum Küstenland und Friaul bahnt sich die Wiederbelebung einer lange verschüttet oder irregeleitet gewesen, in ihren künftigen kulturellen und materiellen Kraft gar nicht abzuschätzenden Harmonie eines alten historischen Raumes an...« (meaning: the old historian region around Slovenia, the coastline and Friuli became really harmonized because ofstrong relations between the States in the past. This development offers great opportunities for all parties.) one can imagine that this was only a vision putted down to paper. However, today — to my great pleasure — this vision becomes more and more lived reality.
